These terms govern your use of Postcards. By creating an account or using the app, you agree to them. If you do not agree, do not use Postcards.
Eligibility
You must be at least 13 years old to use Postcards. If your country requires a higher age for digital consent, you must meet that age. If you are under the age of legal majority where you live, a parent or guardian must agree to these terms on your behalf.
Your account
You are responsible for the activity on your account, for keeping your phone number and device secure, and for the content you send. Do not share your account with anyone else. If you think someone has accessed your account, contact us right away.
Acceptable use
Postcards has zero tolerance for objectionable content and abusive users. The following are prohibited and will be removed when found, with the responsible accounts ejected from the service.
Harassment, bullying, threats, or stalking.
Hate speech or content that targets people based on identity.
Sexual content. We are not a platform for it.
Sexual content involving anyone under 18. This is reported to authorities and to NCMEC where applicable.
Spam, scams, phishing, or impersonation.
Any unlawful activity, including illegal sale of goods.
Content that infringes someone else's intellectual property.
Malware, exploits, or attempts to interfere with the service.
Sharing private information about another person without their consent.
You are responsible for the legality of what you send. We may remove content and terminate accounts that break these rules without prior notice.
Reporting and moderation
You can report any postcard, chat message, photo, or person from inside the app. Long press the content or open the connection screen to start a report. We commit to reviewing every report within 24 hours.
When a report is upheld, we remove the content and may suspend or terminate the responsible account. We do not tell the reported person who reported them.
Blocking
You can block another person at any time from the connection screen. Blocking ends the chat between you and prevents new postcards or messages from arriving. The blocked person is not told they were blocked. You can manage your block list from the You screen.
Your content and license
You keep ownership of the postcards, messages, and photos you create. To run the service, we need a limited license to host, store, copy, and deliver your content to the people you send it to, and to keep it available to you across your devices.
That license is non-exclusive, royalty-free, and worldwide. It exists only to operate Postcards. It ends when you delete the content or your account, subject to the retention window in our privacy policy.
You confirm that you have the right to share what you send, and that doing so does not break someone else's rights.
Termination
You can stop using Postcards and delete your account at any time from the You screen. When you do, we remove your data within 30 days, as described in the privacy policy.
We may suspend or terminate your access if you break these terms, or if we are required to by law. Where it is reasonable, we will give you notice and a chance to put it right. Where the safety of other users is at risk, we may act first and explain after.
Disclaimers and limit of liability
Postcards is provided on an as-is and as-available basis. To the extent permitted by law, we disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the service will be uninterrupted, secure, or free of errors.
To the extent permitted by law, our total liability for any claim arising out of or related to these terms or the service is limited to the greater of one hundred US dollars or the amount you paid us in the twelve months before the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages.
Indemnification
You agree to defend and hold us harmless from any claim, demand, loss, or expense, including reasonable legal fees, that arises from your content, your use of the service, or your breach of these terms.
Governing law
These terms are governed by the laws of the State of Delaware, USA, without regard to its conflict of laws rules. Any dispute that is not resolved informally will be brought in the state or federal courts located in Delaware, and you and we each consent to the exclusive jurisdiction of those courts.
Changes to these terms
We may update these terms from time to time. When we make material changes, we update the date at the top of this page and, if the change is significant, we let you know in the app before it takes effect. Continuing to use Postcards after the change means you accept the new terms.
Apple's role
The following applies if you downloaded Postcards from the Apple App Store. These terms are between you and Postcards. Apple is not a party to these terms and is not responsible for the app or its content. Apple has no obligation to provide maintenance or support for the app, and no warranty obligation.
Apple is not responsible for handling claims you or anyone else make about the app, including product liability claims, claims that the app fails to meet a legal or regulatory requirement, or claims arising under consumer protection or similar law. If a third party claims the app or your use of it infringes their intellectual property rights, Apple is not responsible for the investigation, defense, settlement, or discharge of the claim.
You confirm that you are not located in a country subject to a US government embargo, and that you are not on any US government list of prohibited or restricted parties. You agree to comply with all applicable third-party terms when using the app, including the Usage Rules in the Apple Media Services Terms.
Apple and Apple's subsidiaries are third-party beneficiaries of these terms and have the right to enforce them against you.
